1. ABOUT US

These are the Terms and Conditions for Tranquil Baby, operated by Demelza Sayers.

2. SERVICES PROVIDED

We provide Pregnancy Relaxation Classes, Hypnobirthing Antenatal Courses, 1:1 Support Sessions, Caesarean Birth and Induced Birth Preparation.

Our services are intended for pregnant individuals and, for antenatal classes, other than pregnancy relaxation, birth partners are welcomed and encouraged to attend.

Please note: Our services are educational in nature and do not replace medical advice or treatment.

The Hypnobirthing Antenatal Course:
  • Courses will be delivered by Demelza Sayers DipHB(KGH), a fully qualified hypnobirthing practitioner.
  • Demelza Sayers, trading as Tranquil Baby, cannot accept any responsibility or liability for any loss, damage, or injury to any person or property arising out of or resulting from attendance at the sessions. 
  • Demelza Sayers, trading as Tranquil Baby, reserves the right to decline any application to attend any of the sessions.
  • If you, or your partner, feel unwell whilst in attendance at the sessions you should immediately seek the advice of your midwife, GP or other appropriate health professional.

3. BOOKING & PAYMENT

3.1 How to Book

For Pregnancy Relaxation Sessions, bookings can be made:

For Private Antenatal Sessions, bookings can be made:

3.2 Payment Methods

We accept payment by:

  • Bank transfer for all private course
  • Card payment via Ticket Tailor for all group courses
3.3 When Payment is Due
  • Drop-in classes: Payment required before the start of each class
  • Block bookings: Payment required in full before your first class
  • Private Hypnobirthing Antenatal Courses: Payment required in full
  • Group Hypnobirthing Antenatal Courses:
  • 1:1 Support Sessions (inc. caesarean and induced birth prep): 
3.4 Confirmation

Your booking is confirmed when:

  • Payment has been received in full if booking a drop-in session, making a block booking, or booking a 1:1 support session
  • The deposit has been received if making a booking for either a private or group hypnobirthing antenatal course
  • You have received a confirmation email from us

4. CANCELLATION POLICY

4.1 Cancellation by You (the Client)

Drop-in Classes:

  • No refund for cancellations, but you may transfer to another date with 24 hours notice

Block Bookings:

  • Unused classes from a block booking cannot be refunded
  • Unused classes cannot be transferred to another person
  • Block bookings are only valid for the block of dates booked

Hypnobirthing Antenatal Courses:

  • You may cancel your course booking at any time by contacting Demelza via email or phone.
  • Cancellations made more than one week before the start of the first session will receive a full refund, less the £25 deposit.
  • Cancellations made less than one week, but more than 48 hours before the start of the first session will receive a 50% refund of the full course fee, less the £25 deposit.
  • Cancellations made within 48 hours of the start of the first session will not receive a refund. 
  • The fee will be repaid promptly, and in full, if your baby is born before you begin the course, less the £25 deposit.

1:1 Support Sessions (inc. caesarean and induced birth prep):

  • Cancellations made 48 hours or more before session: full refund or an opportunity to reschedule
  • Cancellations made less than 48 hour before session will incur a 50% charge
4.2 Cancellation by Us

We reserve the right to cancel any class or service with [24 hours/48 hours] notice due to:

  • Insufficient bookings for group classes (minimum 3 participants required)
  • Instructor illness or emergency
  • Venue unavailability
  • Severe weather or circumstances beyond our control

If we cancel:

  • You will receive a full refund/credit to use on another class or service or an alternative date will be offered
  • We will notify you by email or text as soon as possible
  • We are not liable for any indirect costs you may have incurred (travel, childcare, etc.)

4.3 Pregnancy & Birth Considerations

We understand that pregnancy and new parenthood are unpredictable.

If you go into labour before a scheduled course/class, we will offer you a full refund minus any deposit and the cost of classes already attended. If you’re advised by your midwife to stop attending, we’ll refund remaining classes with medical evidence.


5. HEALTH & SAFETY

5.1 Your Responsibility

By booking with us, you confirm that:

  • You are at least 12 weeks pregnant
  • You have completed our medical questionnaire truthfully and in full
  • You have consulted your midwife/GP/health visitor about participating in classes
  • You do not have any medical conditions that would make participation unsafe
  • You will inform us immediately if your health circumstances change
5.2 Medical Conditions

You must inform us if you have or develop any of the following:

  • High blood pressure, pre-eclampsia, placenta previa, SPD/PGP, risk of premature labour, expecting multiples, history of miscarriage, any other pregnancy complications

5.3 Right to Refuse Service

We reserve the right to refuse service or ask you to stop participating if:

  • We believe it is unsafe for you to continue
  • You have not disclosed relevant medical information
  • You have not obtained required medical clearance

In such cases, you will be offered a pro-rata refund for unused sessions.

5.4 Participating at Your Own Risk

While we take all reasonable precautions to ensure your safety, you participate in our classes/services at your own risk.

You should:

  • Listen to your body and stop if something doesn’t feel right
  • Ask questions if you’re unsure about any movement or activity
  • Stay hydrated and take breaks when needed

6. ATTENDANCE & CONDUCT

6.1 Late Arrivals

Please arrive 5 minutes before your class starts.

If you arrive more than 10 minutes late:

  • You may join at the instructor’s discretion, but will have missed the introductions and starter activity
  • No refund or credit will be given

6.2 What to Bring

Please bring:

  • For pregnancy relaxation classes: Water bottle, comfortable clothing, pillow or pregnancy pillow
  • For group hypnobirthing antenatal classes: Pillow or pregnancy pillow, blanket, notepad, comfortable clothing
6.3 Children

Children are not permitted in classes

6.4 Behaviour

We reserve the right to ask you to leave without refund if:

  • Your behaviour is disruptive or disrespectful
  • You are under the influence of alcohol or drugs
  • You behave in a way that makes others uncomfortable

We aim to create a safe, welcoming, inclusive space for all.


7. PHOTOGRAPHY & SOCIAL MEDIA

7.1 Photo Consent

We may take photographs or videos during classes for:

  • Social media promotion
  • Website content
  • Marketing materials

By attending our classes, you consent to being photographed unless you have specifically opted out via our photo consent form.

You can opt out at any time by emailing us

We will never tag you or use your name without explicit permission

Photos of babies/children will only be shared with explicit written consent from the parent

7.2 Your Own Photos/Videos

You are welcome to take photos for personal use, but please:

  • Do not share photos that include other participants without their permission
  • Do not photograph or video other people’s children
  • Do not livestream or record the class without permission

8. INTELLECTUAL PROPERTY

All materials provided (handouts, guides, videos, course content, etc.) are protected by copyright and are for your personal use only.

You may not:

  • Any recording or written material included as part of this course or arising from this course (whether or not protected by trademark and copyright laws) may not be used other than for the personal use of the participant without obtaining prior written permission.
  • You, the participant, agrees not to record the course or any part thereof.

9. INSURANCE & LIABILITY

9.1 Our Insurance

We hold Public Liability Insurance [and Professional Indemnity Insurance] with Holistic.

A copy of our insurance certificate is available on request.

9.2 Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any injuries sustained during classes if you have not disclosed relevant medical conditions
  • We are not liable for loss or damage to personal property
  • We are not liable for any indirect costs (travel, childcare, etc.) if we need to cancel
  • Our liability is limited to the amount you have paid for the service

This does not affect your statutory rights or our liability for death/personal injury caused by our negligence.


10. DATA PROTECTION & PRIVACY

We collect and store your personal information (name, contact details, medical information) in accordance with UK GDPR and Data Protection Act 2018.

  • Booking and payment history
  • Emergency contact details
10.2 How We Use It
  • To provide our services to you
  • To contact you about your bookings
  • To send important updates about classes
  • To ensure your safety during activities
  • To send marketing emails – only if you’ve opted in
10.3 How We Store It
  • Securely on a password-protected laptop
  • For as long as necessary to provide services and for legal requirements
  • We will never sell your data to third parties
10.4 Your Rights

You have the right to:

  • Access your data
  • Correct inaccurate data
  • Request deletion of your data
  • Opt out of marketing emails
  • Withdraw consent at any time

11. COMPLAINTS

We hope you’ll love our services, but if something goes wrong:

  3. We aim to resolve complaints within 14 days

12. CHANGES TO TERMS

We may update these Terms & Conditions from time to time.

When we do:

  • We will update the “Last updated” date at the top
  • We will notify existing clients by email
  • Continued use of our services means you accept the new terms

13. GENERAL
13.1 Entire Agreement

These Terms & Conditions (along with our Privacy Policy) constitute the entire agreement between us.

13.2 Governing Law

These terms are governed by the laws of [England and Wales / Scotland / Northern Ireland].

Disclaimer

  • I, Demelza Sayers, am a trained hypnobirthing consultant and can facilitate you and your partner to safely learn the techniques which the Tranquil Baby Hypnobirthing Antenatal course teaches. I am not medically trained, and the course is not a substitute for the advice of or the presence during birth or any part of pregnancy or labour of a qualified medical practitioner, midwife or obstetrician. It does not represent in fact or otherwise an alternative to appropriate medical care or professional medical advice in any way, shape or form. 
  • Any questions or doubts you have about the use of hypnobirthing should be discussed by you with your medical caregiver and the safety of or the appropriateness of this course be confirmed with your medical caregiver prior to undertaking the course. 
  • Please note, you do not have to complete any exercise you are uncomfortable with or are unsure about. An important part of hypnobirthing is to listen to your body and follow your instincts.
